political dynasty

i have read a youngblood article in the inquirer entitled, "dynasties."
the contributor says that the constitutional prohibition on political dynasty has no enabling law and asks: "why forbid someone, who is a Filipino citizen, of legal age and able to read and write, from running for public office? What happens to 'equal access to opportunity for public service' if some people are disallowed from running?"

true, there is no enabling law.

Article II, Section 26 of the 1987 Constitution states that "the State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law." House Bill 5925 defines it as "the concentration, consolidation or perpetuation of public office and political power by persons related to one another."

The sentence seems to be divided into two:

1. the guarantee of equal access to opportunity for public service; and

2. the prohibition of political dynasties.

The two seem to contradict each other as the youngblood contributor says:

"What happens to 'equal access to opportunity for public service' if some people are disallowed from running?"

For me, i am speaking, not as a first-year law student, but as an average-thinking, 27-year-old man.  Logic will tell us that definitely the framers of the constitution will not make a one-sentence law that will have 2 phrases in one sentence contradict one another.

There is also that law in statutory construction that says: in interpreting the law, you always harmonize first the phrases or sentences because the law is assumed of its constitutionality or regularity.

As to the youngblood contributor that says:

"What happens to 'equal access to opportunity for public service' if some people are disallowed from running?"

This is basically the intent of the framers of the constitution, to prevent unequal access to oppurtunity by preventing those in power or those incumbents from consolidating or perpetuating political power by having their relatives run for public office or gobbling up all positions, thereby allowing those not in power not to have an equal opportunity - that's why the second phrase comes: "and prohibit political dynasties as may be defined by law."

I've seen mayor binay on tv being asked on his view on political dynasty. he answered the same thing: "how can there be equal opportunity when some people are prohibited from running."

i know that binay is intelligent and he knows the true answer. why can't he just say that there is no enabling law bec. our legislators don't want to enact the law that would kill them.

what the hell. why can't we people be honest sometimes?

we will have our finals in the 1st week of march.
i can't wait to rest.
i wanna go home to tacloban and rest.

drink beer and see some old friends.
